缓刑缓刑probation对判处一定刑罚的犯罪分子有条件地暂缓执行原判刑罚的制度。通常适用于判处短期剥夺自由的犯罪。《中华人民共和国刑法》规定，对于被判处拘役、3年以下有期徒刑的犯罪分子，根据其犯罪情节和悔罪表现，适用缓刑确实不致再危害社会的，可以宣告缓刑。拘役的缓刑考验期限为原判刑期以上1年以下，最低不少于2个月。有期徒刑的缓刑考验期限为原判刑期以上5年以下，最低不少于1年。缓刑考验期限从判决确定之日起计算。在缓刑考验期内，由公安机关考察，所在单位或基层组织予以配合。如果没有再犯新罪，缓刑考验期满，原判刑罚不再执行，并公开予以宣告；如果再犯新罪，撤销缓刑，把前罪与后罪所判处的刑罚，按照数罪并罚的原则量刑。对于累犯不适用缓刑。被宣告缓刑的犯罪分子，如果被判处附加刑，附加刑仍须执行。《中华人民共和国惩治军人违反职责罪暂行条例》规定，在战时，对被判处3年以下有期徒刑没有现实危险宣告缓刑的犯罪军人，如果确有立功表现的，可以撤销原判刑罚，不以犯罪论处。缓刑不同于监外执行。前者是给罪犯考验期限，而不是执行原判刑罚；后者是在监外执行原判刑罚，监外执行的原因消失后，仍应收监执行。缓刑也不同于死刑缓期执行（见死刑）。前者只适用于判处短期徒刑或拘役的罪犯，且不收监；后者适用于死刑，须将罪犯监禁，并根据其在缓期执行期间的表现决定是执行死刑或实行减刑。
